The Supervisor, Litigation is responsible for working closely with the default litigation manager to ensure, manage and control the day to day functions of the Default Litigation Specialists responsible for monitoring loans with litigation through the foreclosure sale in order to prevent avoidable losses and exposure to Cenlar. This role ensures compliance with all Investor, Insurer, Cenlar, and Client guidelines and requirements and that Cenlar goals are met regarding litigation timeframe, settlement and client/investor delay reporting.

Responsibilities:

  • Reviews litigation or other non-routine tracking reports through Process Management and Director to ensure compliance and timeframes are met
  • Reviews processing and ensures all attorney and client escalations are promptly addressed
  • Works closely with the Default Litigation Manager to respond to internal and external audits
  • Prepares and distributes monthly management and executive reports
  • Oversees all processes of the default litigation department and work closely with staff to prioritize their workflow
  • Monitors and controls litigation and title processing to ensure compliance with investor, insurer, Cenlar and client regulations
  • Reviews processing and ensures all attorney requests for information/documents are completed within 48 hours of the request
  • Ensures all Reinstatements and Pay offs are submitted accurately to cash management
  • Ensures all title and litigation matters are returned promptly to foreclosure when resolved
  • Responsible for keeping abreast of relevant changes to investor/insurer guidelines, industry standards, and client expectations
  • Creates and implements default litigation exception reports
  • Works closely with compliance to implement necessary training, procedures, monitoring and management controls to comply with all changes related to litigation processing
  • Reviews and executes discovery responses
  • Assists in the coordination of trials, depositions and hearings
  • Counsels staff to improve performance in accordance with company policy
  • Completes other duties and projects as assigned by management
  • Responsible for review and exception managing reports in Practice Master
  • Coordinates and delivers of monthly client litigation reports
  • Appropriately assess risk when business decisions are made, include but not limited to compliance and operational risk. Demonstrate consideration for Cenlar’s reputation as well as our clients, by driving compliance with applicable laws, rules and regulations, adhering to Policy, applying sound ethical judgment regarding personal behavior, conduct and business practices, and escalating, managing and reporting control issues, as well as effectively supervise the activity of others and create accountability with those who fail to maintain these standards

Qualifications:

  • Bachelor’s degree or equivalent experience
  • Attorney or previous legal experience preferred
  • Minimum of 5 years mortgage default experience or equivalent experience
  • Previous project management experience
  • Excellent communication skills; oral and written
  • Thorough knowledge of FHA/VA; FNMA/FHLMC servicing guidelines and requirements
  • Familiar with foreclosure and bankruptcy laws in a multi-state portfolio
  • Detail oriented ability to successfully manage multiple priorities, and possess the ability to meet deadlines
  • Strong analytical skills
  • Able to work in fast paced environment
  • Ability to manage workload to meet deadlines
  • Working knowledge with Microsoft Office, spreadsheets and software applications

It is critical that you have an understanding of the following:

  • Requirements under the Real Estate Settlement Procedures Act (RESPA), specifically general servicing standards and loss mitigation practices.
  • Requirements under the Service members Civil Relief Act (SCRA), specifically protections for Service members.
