What it’s all about:
We are seeking a dynamic and skilled professional to join our Loan Servicing Department as a Bankruptcy Foreclosure Specialist. In this role, you will manage the bankruptcy and foreclosure functions within the single-family Loan Servicing Division, ensuring full compliance with federal and state laws, investor and insurer regulations, and internal guidelines. You will oversee delinquency status reporting, identify files that meet foreclosure referral criteria, and prepare recommendations for review by the Assistant Director. This position requires knowledge of CFPB and FDCPA regulations, adherence to all regulatory timeframes, and experience with preparation and participation in regulatory reviews and audits.
What you’ll do on a daily basis:
- Review Chapter 7 and Chapter 13 bankruptcy plans, identify debtor intent and plan feasibility, and prepare required documentation for legal counsel, including proofs of claim, notices, and reaffirmation agreements.
- Refer accounts to foreclosure and bankruptcy legal counsel to initiate action or motions for relief from bankruptcy stay. Prepare foreclosure bids in accordance with investor/insurer guidelines.
- Process pre- and post-petition bankruptcy payments, monitor fees, and research approved bankruptcy plans. Coordinate with the Escrow Department to ensure compliance with bankruptcy-related escrow requirements.
- Maintain foreclosure and bankruptcy workstations in the loan servicing system, manage active pipelines, and update REO workstations and FNMA/Freddie Mac Asset Management systems.
- Prepare monthly internal and sub-servicing reports on delinquency, REO, and mortgage insurance (MI) claim status.
- Communicate with legal counsel, bankruptcy trustees, appraisers, sub-servicing investors, and debtor counsel as needed.
- Cross-train in other servicing functions and assist with special projects as assigned.
What you’ll bring to the team:
- Administer the foreclosure and bankruptcy functions within the Single-Family Loan Servicing Division, including the sub-servicing portfolio, in compliance with internal policies, federal and state laws, and regulatory guidelines.
- Prepare foreclosure bids and coordinate with external legal counsel, bankruptcy trustees, investors, and appraisers.
- Process pre- and post-petition bankruptcy payments and maintain bankruptcy and foreclosure workstations within the loan servicing system, including updates to FNMA and Freddie Mac Asset Management systems, ensuring all required timeframes are met.
- Prepare bankruptcy documentation for legal counsel, including proofs of claim, notices of payment change, post-petition fees, and final cure payments for Chapter 13 matters.
- Attend foreclosure auctions as required.
- Collaborate with customer service, monitor delinquent loans, and support special projects as assigned.
What you’ll need to succeed:
- Paralegal Certification preferred, Associate’s degree in Business Administration or related field.
- Minimum five (5) years’ experience in mortgage collections, foreclosure, and bankruptcy preferred.
- In-depth knowledge of state and federal laws governing bankruptcy and foreclosure, as well as CFPB and FDCPA regulations. Familiarity with government-insured loans, including FHA, USDA, FNMA, Freddie Mac, and VA.
- Exceptional attention to detail and accuracy in handling complex legal and financial documentation.
- Strong analytical and problem-solving skills with the ability to interpret and manage complex transactions.
- Outstanding organizational skills with the ability to prioritize competing deadlines and manage workload efficiently to meet investor and legal timelines.
- Excellent written and verbal communication skills with proven ability to negotiate effectively and convey information clearly.
- Self-motivated and able to work independently, exercising sound judgment while maintaining flexibility in a fast-paced environment.
- Proficient in Microsoft Word, Excel, and related technology platforms.
- Understanding of real estate appraisals and title documentation.
- Bilingual (Spanish or Portuguese) preferred.
- Use of a personal vehicle, a valid driver’s license, and proof of insurance are required.
