Position Overview

This Legal Counsel, Spain role will function as a key member of Insulet’s EMEA Legal team and is based at the company’s Madrid office. This role reports to a Director, Legal Counsel. The ideal candidate is a highly collaborative and experienced commercial attorney who has a proven track record of being successful and valued working as a partner with business clients in an in-house setting, preferably within the life sciences industry.  He or she must possess excellent legal and business judgment and must be able to demonstrate success balancing the need to limit risk to the company with the goal of supporting the creativity, enthusiasm, and pace of internal clients as we grow the company together. The candidate must be able to work independently but collaboratively within a fast-paced, high-performance environment, providing legal advice and guidance related to a wide range of commercial contracts and other business matters. The role will also support other business needs and large-scale special projects, as needed.

 

Responsibilities

  • Legal Advisory. Responsible for providing solution and business-oriented legal advice, support, counsel, representation, and services to various commercial teams, including Market Access, Marketing, and Sales.

  • Contract Management. Draft, review, negotiate, and provide guidance on a wide variety of agreements and documents including government tenders, non-disclosure agreements, and master services agreements ensuring both legal and business objectives are met.

  • Market Access Support. Counsel the Market Access team on government tenders, new product launches, and post-launch activities.

  • Promotional and HCP Activities. Counsel and advise the Marketing team with respect to marketing and promotional activities, including review, and approval of marketing campaigns and promotional materials. Support Healthcare Professional (HCP) engagement initiatives, including activity concept review, anti-bribery aspects and transparency requirements, and providing commercial contracts for HCPs.

  • HR Support. Occasionally support the Human Resources team on employment matters.

  • Risk Management. Work closely with the business teams to understand the needs and strategic objectives of the company to provide high quality, pragmatic, and focused legal advice and assist in growing the company’s business.

  • Monitoring Changes. Research, track and identify changes in relevant laws, regulations, and industry standards that affect the medical device industry in Spain.

  • Miscellaneous. Performs other duties as assigned.

  • Contractual Agreements.  Decision-making authority on the review, negotiation, and finalization for contracts.

  • Risk Assessment. Ability to issue spot, evaluate potential legal risks, and implement appropriate risk mitigation strategies.

  • Policy Implementation. Authority to help develop, implement, and enforce company-wide legal policies and procedures.

  • Power to liaise directly with internal and external parties as necessary and appropriate.

    The ability to leverage his/her business judgment and legal skills to help close important business deals.

  • Proven experience solving both practical and multi-variable problems and challenges, with excellent risk-based judgment.

  • Experience in negotiating and drafting various types of agreements and drive resolution on difficult or unique issues based on company objectives.

     

Education and Experience

  • Qualified lawyer in Europe

  • 5-8 years post-qualification experience, including experience in an in-house Legal department.

  • Experience with a medical device or life sciences company is preferred.

  • Native level of fluency in English and Spanish, both oral and written.

Additional Information

  • The position is hybrid at our Madrid office.

  • Travel within Europe is estimated at up to 5%, with occasional travel to corporate headquarters in the US.
