Position Summary/Overview
The Counsel, Employment Law & Litigation will serve as a key member of IES Holdings' Legal Department, providing strategic legal counsel on employment matters and managing litigation across the company's diverse operations. This role will partner with business leaders and HR to navigate complex employment issues while supporting IES Holdings' continued growth. The position requires a business-minded attorney who can balance legal risk management with practical business solutions across IES Holdings' operations. The ideal candidate will bring substantial employment law expertise and litigation management experience to protect the company's interests while enabling business objectives. This role offers significant opportunity to shape employment practices and litigation strategy for a growing public company with 9,000+ employees across multiple locations.
Key Responsibilities and Duties
Employment Law
- Serve as the primary legal advisor on employment law matters across all IES Holdings business units and subsidiaries
- Provide strategic counsel to HR and management on complex employment issues including hiring, discipline, termination, leaves of absence, accommodations, and wage and hour compliance
- Develop, implement, and regularly update company-wide employment policies, handbooks, and procedures to ensure compliance with federal, state, and local laws across all jurisdictions where IES operates
- Lead workplace investigations into allegations of discrimination, harassment, retaliation, and other employee misconduct
- Partner with HR to develop and deliver training programs on employment law compliance for managers and employees
- Advise on labor relations matters
- Background in compliance program development and implementation
- Knowledge of construction industry-specific employment issues (e.g., Davis-Bacon Act, prevailing wage requirements)
- Experience with alternative dispute resolution methods including mediation and arbitration
A Juris Doctor (JD) is required for this role, along with a minimum of 6 years of relevant experience in employment law and litigation.
Legal and Technical Skills
- Employment Law Expertise: Deep understanding of federal, state, and local employment laws and regulations
- Litigation Management: Proven ability to develop case strategy, manage discovery, and coordinate with outside counsel
- Legal Research and Writing: Exceptional legal research skills and ability to draft clear, persuasive legal documents
- Risk Assessment: Strong analytical skills to evaluate legal risks and provide practical business solutions
- Regulatory Compliance: Knowledge of SEC reporting requirements and public company obligations
- Contract Drafting and Negotiation: Experience drafting and negotiating employment-related agreements
Business and Leadership Skills
- Strategic Thinking: Ability to align legal strategy with business objectives and long-term company goals
- Project Management: Strong organizational skills to manage multiple complex matters simultaneously
- Stakeholder Management: Ability to build relationships and collaborate effectively with business leaders, HR, and external parties
- Budget Management: Experience managing legal budgets and controlling outside counsel costs
