Terms of Reference
1. Conducting comprehensive factual and legal analysis of protection against
retaliation (PaR) cases.
Specifically, the consultant must assess cases focusing on:
(a) Whether the UNHCR colleague engaged in a protected activity.
(b) Whether detrimental action (i.e., retaliation) occurred.
(c) Whether a prima facie case exists that the protected activity was at least a
contributing factor to the detrimental action.
2. Speaking directly with complainants, as required, to clarify and verify facts.
3. Preparing written legal memoranda summarizing findings and assessments.
4. Supporting policy review and providing guidance related to PaR.

7. General Background of Project or Assignment:
The UNHCR Ethics Office is mandated to receive, review, and assess complaints of retaliation for engaging in protected activities, as defined in the Policy on Protection against Retaliation. In fulfilling this mandate, the Office requires specialized legal and analytical support to review case files, engage with complainants, and provide comprehensive assessments to determine whether a prima facie case exists.
Additionally, the Office is strengthening its policy framework and guidance related to PaR, and requires expert support in reviewing, updating, and advising on relevant policies and internal guidance materials.

9. Overall Purpose and Scope of Assignment:
Concise and detailed description of activities, including measurable outputs and delivery dates, impact indicators (what qualitative and quantitative results would be achieved upon completion of individual contract), performance indicators (timelines, value of the service rendered in relation to the cost, timeliness) and work plan:
Deliverables:
Case Memoranda: Written memoranda for each case reviewed, addressing prima facie assessments and, where applicable, full retaliation reviews.
Policy Support:
A written note with recommendations for strengthening the PaR policy framework.
Draft or revised internal guidance documents for the Ethics Office on PaR.
10. Required level, qualifications and work experience:
The assignment is for an Individual Consultant
a. Be either a recent graduate (having completed their studies within two years of applying) or a current student in a graduate/undergraduate school programme from a university or higher education facility accredited by IAU/UNESCO; and
b. Have completed at least two years of undergraduate studies in a field relevant or of interest to the work of UNHCR.
