The hiring amount for this position is between $90,420.31 to $110,741.84 annually. Starting pay for this position is based on applicable education, experience, and internal equity.   • The City of Charlottesville manages its own retirement system which offers both a defined benefit and a defined contribution option.  While the City does not participate in VRS, the City has a Portability Agreement with VRS and there are certain provisions that must be met. This position performs responsible professional work overseeing, managing, investigating, and responding to employee relations matters. Provides guidance, expertise, and support to city-wide managers and supervisors regarding corrective action, performance management, grievances, and employment investigations. Will coordinate with the Labor Relations Manager for investigations that involve collective bargaining covered employees. Work is performed under limited supervision and reports to the Director or Deputy Director of Human Resources.

Position Duties

  • Oversees and serves as a primary point of contact for employee relations matters, allegations of misconduct, discrimination, harassment, and other workplace complaints or grievances.
  • Advises supervisors and managers in the handling of confidential employee relations matters, coaching, job performance issues, and grievances and in determining appropriate corrective action. Attends meetings on related matters as appropriate. Provides general conflict resolution or mediation assistance in employee related disputes.
  • Conducts, and/or directs the conduct of, investigations into allegations of misconduct, discrimination, harassment, and other workplace complaints; including developing investigative plans, conducting interviews, analyzing evidence, and preparing reports detailing findings and recommendations.
  • Oversees, develops, and assists in drafting performance management and disciplinary documents, including but not limited to employee coaching, written reprimands, individual development plans, last chance agreements, etc. 
  • Interprets, advises and makes recommendations on all personnel issues, providing detailed research and supporting evidence to demonstrate analysis into applicable policy, law or rule, collective bargaining agreement or procedure.
  • Provides consultation and support to managers, supervisors, and employees on complex issues and programs. Interprets City personnel policies, employee union contracts, and federal and state laws.
  • Consults with HR management and/or legal counsel as appropriate on matters of high risk and significance. 
  • Acts as a liaison for mandatory Employee Assistance Program (EAP) referrals related to employee relations matters.
  • Oversees and effectively maintains documentation, tracking, and compiling of employee relations data and records; creating and ensuring tracking systems are in place for all related actions taken.
  • Maintains impartiality and objectivity in all employee relations matters.
  • Provides recommendation on the use of an external investigator, when necessary and acts as the point of contact.
  • Leads the creation, oversight, and presentation of employee relations trainings and facilitates training on employee relations topics and compliance in coordination with the HR staff assigned to city-wide training and development.
  • Supervises, coaches, trains, assigns, monitors work activities, and evaluates the performance of assigned staff; interviews, selects, and administers disciplinary action to subordinate employees, in accordance with established personnel policy and procedures. Establishes professional standards for work quality, quantity, performance, and accountability.
  • Ensures policies, procedures, and practices comply with applicable federal, state, and city laws including but not limited to FMLA, ADA, Title VII, FLSA, FTA regulations, CBAs, and City policies/procedures.
  • Establishes bi-weekly meetings to update the Deputy Director of HR and Director of HR on related personnel matters.
  • Responsible for appropriate use and maintenance of City equipment, tools and other resources, including work time.
  • Regular and reliable attendance.
Other Duties
  • May testify at administrative, legal, or other hearings related to investigations and/or other employee relations matters.
  • Performs additional duties to support operational requirements as apparent or assigned.

Minimum Qualifications

Education and Experience: Candidates may qualify by demonstrating the required knowledge and skills outlined for the job through experience(s) other than formal education.

  • Bachelor’s degree in human resources, business administration, communications, law, or a related field AND 5 years of experience in human resources including 2 years in investigations or other employee relations related function.
OR
  • Associate degree in human resources, business administration, communications, law, or a related field AND 7 years of experience in human resources including 2 years in investigations or other employee relations related function.
OR
  • High School diploma or GED AND 9 years of experience in human resources including 2 years in investigations or other employee relations related function.
OR
  • An equivalent combination of education and experience may be considered in lieu of the specific requirements listed above.
Preferred:
  • Employee relations experience in a unionized public sector environment. 
  • Supervisory experience in a public sector environment. 
  • Professional certification such as PSHRA-CP or SCP, PHR, SPHR, SHRM-CP or SCP. 
Certifications/Licenses/Other Requirements:
  • Must obtain and maintain a valid Virginia driver’s license and acceptable driving record according to city criteria OR must be able to provide own transportation to and from job, meetings, and related job sites. 
  • Required to successfully pass a pre-employment background check and pre-employment drug screen.

  • Comprehensive knowledge of public sector human resources principles, practices, compliance, policies and procedures including state and federal law, employment practices and industry best practices.
  • Comprehensive knowledge of investigative methods and techniques and investigatory report writing.
  • Thorough knowledge of research methods, data collection, report presentation and statistical analysis.
  • Knowledge of effective personnel management.
  • Familiarity with collective bargaining agreements, principles, and practices and related progressive disciplinary procedures.

  • Intermediate: ability to read and understand written materials such as newspapers, magazines, journals, multi-step instruction manuals, reference materials and governmental regulations.
Writing
  • Advanced: ability to develop materials such as researched responses, reports, journals, speeches, manuals, or critiques. Ability to tailor writing to specific audiences and explain complex thoughts and ideas in writing. Uses investigatory techniques to develop effective reports. 
Math
  • Intermediate: ability to deal with number systems; simple formulas, practical application of fractions, percentages, ratios/proportions and measurement.
Communication Skills
  • Advanced: Establishes and maintains effective working relationships with city staff, management, city officials, outside agencies, and the public. Demonstrates mediation, conflict resolution and consensus building skills. Maintains confidentiality of sensitive information and communicates with tact and diplomacy. Communicates current and revised policies effectively and clearly. Contact may involve support of controversial positions or the negotiation of sensitive issues. Evaluates customer satisfaction, develops cooperative associations, and utilizes resources to continuously improve customer satisfaction.
Independence and Decision-Making
  • Requires Limited Direction: normally completes work according to their own judgment, requesting supervisory assistance occasionally. Special projects are managed with little oversight and assignments may be reviewed upon completion. Performance reviewed periodically. 
  • Analyzes complex problems, conducts comprehensive research, identify alternative solutions, project consequences of proposed actions, and make recommendations for resolution and implementation.
Technical Skills
  • Advanced: Requires high level skills and extensive knowledge in approaches and systems, which affect the design and implementation of major programs and/or processes organization wide. Skilled in the operation and use of standard office software including Microsoft Office applications, SAP, and other departmental systems/software.

Physical Demands

  • Sedentary work:  Exerting up to 10 pounds of force occasionally, and/or a negligible amount of force frequently or constantly to lift, carry, push, pull or otherwise move objects.
  • Requires visits to other City offices and facilities, and occasional trips to external offices.
  • Must occasionally move about inside the office to access file cabinets, office machinery, etc. Must constantly position self to maintain files in file cabinets.
  • Must be able to communicate information and ideas so others will understand. Must be able to exchange accurate information in these situations.
  • Ability to observe details at close range (within a few feet of the observer).
Machines, Tools, Equipment, Software and Hardware:
  • Typically requires use of standard office equipment and telephone, and related software and hardware; and any other equipment as appropriate or as assigned.  
Work Environment
  • Work is performed in an office environment where there may be exposure to computer screen for extended periods of time, monitor glare and dust.
