Duties & Responsibilities
General Duties:
- Handles complex, sensitive cases with impartiality and sound judgment
- Ensures compliance with University policies and federal/state laws, including Title VII, Title IX, Clery, EEO, and VAWA
- Maintains current knowledge of civil rights regulations and higher education trends
- Upholds integrity of the hearing process, free from bias or conflict of interest
- Performs other related duties as assigned
Decision Maker/Hearing Officer Duties:
- Serves as a Decision Maker/Hearing Officer for UH Hilo’s Office of Equal Opportunity
- Oversees and conducts live hearings in accordance with University policies, including Title IX requirements
- Makes relevancy determinations, analyzes evidence, and issues impartial findings and sanctions
- Ensures timely, equitable communication with all parties throughout the hearing process
- Prepares clear, well-reasoned written determinations and distributes findings simultaneously
- Manages cases involving employee and student misconduct related to discrimination and sexual misconduct
- Maintains professional correspondence and procedural compliance from complaint to resolution
Minimum Qualifications:
- Possession of a baccalaureate degree in Business Administration, Education, Human Resources, Social Sciences or related field and 3 years of progressively responsible professional experience with responsibilities for employee or student misconduct investigations, Title IX programs, EEO programs, Human Resources, litigation or related field; or equivalent education, training or experience which provides the required education, knowledge, skills and abilities as indicated.
- Demonstrated comprehensive understanding of the definition of “sexual harassment,” as contained in the Updated Title IX Regulations, effective August 14, 2020, and how the threshold of this definition is met, according to current jurisprudence.
Desirable Qualifications:
- Possession of a Juris Doctorate from an accredited law school.
- Experience in employment law or related field.
- Title IX and/or other employment-related Decision Maker training and certification.
- Experience in an institution of higher education with demonstrable knowledge of Title IX, Title VII and other civil rights laws.
- Demonstrated comprehensive understanding of due process within higher education investigative and adjudicatory processes.
- Demonstrated ability to remain neutral while adjudicating cases or conducting investigations and to work under multiple deadlines and sensitive timelines.
- Demonstrated ability to operate a personal computer and apply word processing software.
- Understanding of the dynamics of gender-based violence.
- Experience working with people of various backgrounds.
