The Superior Court of California, County of San Bernardino, is seeking a detail-oriented, ethical, and highly motivated professional to join our team as a Court Investigator. This critical role supports the judicial process by conducting civil investigations of guardianships and conservatorships in the Probate Court.

About the Position
Under general supervision, conducts civil investigations of conservatorships and guardianships in the Probate Court; writes detailed reports and makes recommendations to Judicial Officers; and performs related duties as assigned.

Distinguishing Characteristics
A Court Investigator conducts impartial investigations, which includes interviewing interested parties, proposed wards and conservatees, to identify and interview professional witnesses, and gather and review relevant documents and data in order to assist Judicial Officers in making informed decisions regarding Probate guardianships and conservatorships. Duties and responsibilities are carried out with considerable independence within a framework of established policies and procedures.
 
Employees in this class typically report to the Supervising Court Investigator.
 
Court Investigator differs from the class of the Supervising Court Investigator in that the latter serves as a full supervisor and has administrative responsibilities for the unit.

Position Duties

  1. Reviews guardianship and conservatorship case files including court petitions, orders, questionnaires and other legal documents; gathers and reviews educational and financial records; examines reports and documentation obtained from collateral sources such as child welfare history, information from social workers and therapists, educational records, law enforcement records, county and state agen­cies reports including Adult Protective Services, Public Guardians, Department of Children and Family Services, Regional Centers and state mental health institutions.
  2. Obtains, reviews and evaluates medical and mental health records and other pertinent medical infor­mation; may recommend for psychiatric or psychological evaluations.
  3. Conducts interviews and/or field visits of proposed and existing conservatees, conservators, guardians, family members and minors, and assesses living conditions, financial and health status and safety risks; reviews financial and medical records; investigates complaints regarding physical and/or financial abuse; arranges for interviews of parties outside the Southern California area and other case-related persons (i.e., hospi­tals, caregivers, medical personnel, law enforcement personnel and social service personnel).
  4. Completes risk assessments to rule out domestic violence, abuse or any other safety, health or welfare concerns that may affect the conservatee and minors safety; addresses problems identified and refers parties to community agencies for long-term counseling when necessary.
  5. Prepares detailed court reports with summary of issues, information obtained during investigations and recommendations for judicial action; may be required to testify in court regarding same.
  6. Informs concerned parties of laws, regulations and procedures of the Court; explains scope of services and legal rights to clients.
  7. Provides information on the nature of conservatorship and guardianship proceedings to families, the public and attorneys; may speak before community groups.
  8. Presents oral and written reports and recommendations to the court as to whether a petition should be granted or denied; maintains case documentation, prepares reports and writes routine correspondence; attends and participates in case management meetings and presentations.
  9. Collects and compiles statistical workload reports; attends meetings, trainings and conferences; represents the section/department with other divisions, departments and public agencies.
  10. Performs other duties as assigned.

Minimum Qualifications

Graduation from an accredited four (4) year college or university with a degree in a science, a social science, a behavioral science, liberal arts or nursing, and two (2) years of experience performing casework or investi­gations in a legal, financial, law enforcement or social services setting; or an equivalent combin­ation of education, training and experience. A master's degree or higher and experience working with the elderly, devel­op­mentally disabled, and children are preferred.

Licenses; Certificates; Special Requirements:
Continuing education requirements must be met annually pursuant to criteria outlined in California Rule of Court 10.478.

A valid California Class C driver's license and the ability to maintain insurability under the Court's vehicle insurance program.

  • Effective investigative and interview methods and techniques;
  • Problems of the elderly, developmentally disabled and brain damaged;
  • Characteristics and signs of abuse, domestic violence and substance abuse;
  • Issues relating to family dysfunctional behavior/development;
  • Child development and factors contributing to the development of behavioral issues;
  • Medical and psychological terminology, conditions and treatments;
  • Governmental and private community resources and referral agencies;
  • Relevant Probate Code, legal terminology, court operations and courtroom procedure; courtroom etiquette and conventions;
  • Federal, state and local laws, regulations and court decisions applicable to area of assigned responsi­bility including laws related to conservatorships and guardianships;
  • Advanced research methods and analysis techniques;
  • State regulations pertaining to client confidentiality;
  • Navigational tools to aid in travel from one location to another in a timely manner;
  • Court ordinances, codes, procedures and practices regarding computer hardware, software and data security;
  • Principles and practices of sound business communication; correct English usage, including spelling, grammar and punctuation;
  • Safety policies and safe work practices applicable to the work.

Selection Process

  1. Human resources will evaluate all applications to identify those who meet the minimum qualifications, as well as any desirable qualifications listed. Only candidates who fulfill these requirements will proceed in the process.

  2. Your responses to the supplemental questions may be scored and ranked. Depending on the number of applicants, you might also need to complete an online assessment or a screening interview.

  3. If you successfully pass step 2 and meet the minimum qualifications, your name will be added to the eligible list. From this list, you may be considered for an interview. Please note that being on the eligible list does not guarantee an interview or a job offer.

The employee is frequently required to lift up to twenty-five (25) pounds unaided.

Specific vision abilities required for this job include close vision, distance vision, use of both eyes, depth perception, color vision and the ability to adjust focus.
