Job Description

Position Overview

The TopBuild legal team is in search of an experienced, detail-oriented, positive and passionate litigator, preferably with a background in the construction industry. This role involves managing construction defect, auto, contract, general liability and construction collection litigation, claims, and disputes. In this role, you will work closely with cross-functional teams, including key operational leaders, to manage and resolve business disputes. This role is integral to our team, requiring practical guidance and a collaborative approach to support our mission effectively.

Key Responsibilities

• Lead and manage all phases of construction-related litigation, arbitration, and alternative dispute resolution, including pre-litigation risk assessment and case strategy.
• Handle and supervise pre-litigation claims involving construction defects, delays, contract disputes, insurance coverage, liens and bond matters.
• Collaborate with project managers, executives, and external counsel to assess legal exposure and develop practical, business-minded solutions.
• Review and advise on contracts, change orders, and legal correspondence related to ongoing and prospective litigation. Draft various correspondence on behalf of and in collaboration with client leaders.
• Actively manage a nationwide litigation docket, including quarterly review of case load. Timely advise on important case updates.
• Manage and review outside counsel’s activities in discovery, including gathering responsive materials, reviewing written discovery drafts, identifying and prepping witnesses, and working with outside counsel to request various discovery from opposing parties.
• Participate and oversee depositions, mediations, and trial, including preparation activities when needed.
• Provide legal guidance on regulatory compliance, licensing, and risk management.
• Monitor legal developments relevant to construction law and proactively update internal stakeholders.
• Provide and participate in cross-training opportunities within the legal team.
• Other duties as assigned.

Qualifications

The successful candidate will be a team player, self-motivated, and able to demonstrate a history of successfully resolving challenging legal issues and effectively delivering sound and clear legal advice in a business setting to internal business stakeholders. He or she will also be able to work cross-functionally and build consensus among various stakeholders.

• Litigation experience with a variety of matters. Knowledge of construction contracts, insurance, and relevant state and federal laws. Ability to manage a nationwide case load and regularly review status of cases with senior leadership.
• Sound judgment. Proven track record of sound judgment in devising innovative litigation strategies and evaluating potential resolutions. Strong analytical and research skills. Good, independent judgment is a prerequisite.
• Comfortable providing guidance to other attorneys and/or business with the ability to evaluate and articulate risk in the context of construction operations. Customer-focused and service-oriented. Excellent interpersonal, relationship-building, and communication skills. Ability to think creatively and devise solutions to challenging problems. Partner to business clients.
• Ability to advance a positive spirit of partnership and collaboration with team members, internal clients, senior leadership, and outside counsel.
• Highly organized, detail-oriented and able to manage and think analytically about projects. Proactive and able to function effectively in environment of rapidly changing demands. Capable of performing responsibilities within specified deadlines and handling multiple priorities.
• Perform duties under minimal supervision while exercising discretion and independent judgment.
• Bilingual (Spanish/English) is a plus but not required.

EDUCATION AND CERTIFICATIONS

• Minimum Degree: Juris Doctor
• 7+ years of experience in litigation, prefer 2+ years of experience in public company
• Special Certification or Licensing: Licensed to practice law in at least one U.S. jurisdiction, in good standing, and eligible for Florida in-house practice.
• Special Requirements: Board certification in construction law preferred but not required.

Occasional Work From Home option in the Daytona Beach area may be available

PHYSICAL REQUIREMENTS

Work is performed in a typical office environment and may require standing, bending, lifting of boxes and packages under 10 lbs.
