Pay begins at $48,799.25 for Deputy Court Clerk and is dependent upon applicable experience.
In addition to the base salary, this full-time position is eligible for an annual performance bonus as well as a longevity bonus.

Description:
The Court Clerk’s office will provide excellent customer service to the general public, and in all other aspects of the job. The purpose of this classification is to perform administrative and clerical duties in support of the following jurisdictions:  General  Sessions  Court, TCA 18-4-203, Traffic Court, and Juvenile Traffic Court pursuant to TCA 18-1-104. This position will also be required to perform the functions of a  Judicial  Commissioner pursuant to  TCA 40-1-111. duties and responsibilities include, but are not limited to: maintaining the criminal warrants issued for violations of and  offenses against  criminal  laws for  the  State of Tennessee;  maintaining all  dispositions  of traffic law violations and forwarding these violations accordingly to the Department of Safety.  Under limited supervision, reports to the Court Clerk, Chief Deputy Court Clerk,  and Court Administrator, with final approval of judicial commissioner duties granted by the Town Judge.
 

Position Duties

The following duties are normal for this position.  The omission of specific statements of the duties does not exclude them from the classification if the work is similar, related, or a logical assignment for this classification. While this is intended to be an accurate reflection of the current job, management reserves the right to revise the job. Other duties may be required and assigned.

General Sessions Duties:
  • Being officially sworn in as a Deputy Court Clerk, granting the authority to carry out the responsibilities of the elected Court Clerk. Deputy Court Clerk’s oath referenced in TCA 18-1-103. Having concurrent authority with the judge to issue warrants and other processes and writs, other than those that the law requires to be issued only by a judicial officer, and has the authority to set the amount of bond in the absence of the judge.
  • Notifies prosecutors, officers, defendants, plaintiffs, and all other parties of scheduled court dates; including but not limited to: receiving and filing notice of appearance, waivers of arraignment and issuing subpoenas.
  • Attend court and maintain all dockets.
  • Keep minute entries as required.
  • Maintain and organize paperwork for each case file during court.
  • Promptly make any and all entries necessitated by statute.
  • Notify the TBI of criminal dispositions as soon as practical but no later than 3 business days of the criminal proceedings.
  • Submit convictions to the Department of Safety within 30 days.
  • Prepare all cases that have been bound over to Circuit Court.
  • Maintain confidentiality of records pursuant to TCA 16-15-303.

Traffic Court Duties
Being officially sworn in as a Deputy Court Clerk, granting authority to carry out the responsibilities of the Municipal Court Clerk as set out in the Charter and Ordinances of the Town of Smyrna. Must complete at least three hours of training or continuing education courses each calendar year; this training must be approved by the Administrative Office of the courts, and attendance needs to be certified by the clerk.  TCA 16-18-309

  • Maintains an accurate and detailed record and summary report of all financial transactions and affairs of the court. The record and report shall accurately reflect all disposed cases, assessments, collections, suspensions, waivers, and transmittals of litigation taxes, court costs, forfeitures, fines, fee,s and any other receipts and disbursements. 
  • Maintain Smyrna’s juvenile traffic records through jurisdiction authorized by the Rutherford County Juvenile Court Judge. Performs customer service functions; assists customers at the window, answers phones, provides information/assistance regarding department services, activities, procedures, fees, or other issues; distributes forms/documentation as needed; responds to routine questions, complaints or requests for service; initiates problem resolution. 
  • Enters payments; prepares bank deposits. 
  • Prints citations, prepares docket, and keeps record of Traffic School attendance.
  • Prepare files and dockets for contested traffic citations and environmental citations.
  • Prepare files and dockets for juvenile traffic citations. 
  • Attend court and keep dockets
  • Disposition entry and conviction reporting.

Judicial Commissioner Duties
Each judicial commissioner shall be appointed by the Smyrna Town Judge and submitted for approval to the County Legislative body, to serve a term of 4 years. Serves as a magistrate as defined in TCA 40-5-102, however, will be distinguished by the title Judicial Commissioner. Subject to Rule 10 of the Code of Judicial Conduct, the same as a Judge. A judge, within the meaning of this Code, is anyone who is authorized to perform judicial functions, including but not limited to an officer such as a magistrate, referee, court commissioner, judicial commissioner, special master, or an administrative judge or hearing officer.

  • Issues search warrants and felony arrest warrants upon a finding of probable cause and pursuant to requests from on-duty law enforcement officers and the general public in accordance with the procedures outlined in title 40, chapters 5 and 6. This includes conducting probable cause hearings to determine probable cause for arrest; confirming the existence of probable cause, legal grounds, or sufficient evidence to issue warrants; reviewing, condensing, and entering into the computer pertinent information from police affidavits or from citizens' affidavits for issuance of warrants or criminal summons.
  • Prepares and issues criminal summons for the general public as prescribed by law. 
  • Reviews and confirms probable cause for misdemeanor citations and secures the appropriate signatures and affidavits for the citations.
  • Issues mittimus following compliance with the procedures prescribed by § 40-5-103.
  • Appoints attorneys for indigent defendants in accordance with applicable law and guidelines established by the presiding general sessions judge.
  • Sets and Approves bonds and the release on recognizance of defendants in accordance with applicable law and guidelines established by the presiding general sessions judge.
  • Issues injunctions and other appropriate orders as designated by the general sessions judges in cases of alleged domestic violence. Including issuing domestic assault bond conditions for defendants in domestic arrests, issuing DUI bond conditions for defendants arrested for DUI.
  • Has authority to order source hearings prior to defendant's release from jail, pursuant to local court rules..
  • Issues ex parte orders of protection for the chancellor on weekdays, when the chancellor is not available, and on weekends, holidays, and at any other time when the chancellor is unavailable to set bond.
  • Maintains a thorough knowledge of TCA Section 40-1-111 through 40-5-201 pertaining to the appointment of Judicial Commissioners by the county legislative body. 
  • Maintains a thorough knowledge of all legal transactions and proceedings associated with General Sessions and Circuit Court operations, including applicable sections of the Tennessee Code Annotated, general manual for Clerks of the Courts, and Local Rules of the Court. 
  • Maintains a thorough knowledge of federal, state, and local laws pertaining to the rights of defendants, victims, and witnesses involved in legal matters before the court. 
  • Maintains a thorough knowledge of the regulations governing the preparation and issuance of warrants for individuals suspected of criminal activity. 
  • Consistently adhere to all policies, procedures, and protocols associated with General Sessions Court operations. 
  • Interacts tactfully and professionally with defendants, witnesses, family members, law enforcement personnel, attorneys, and the public.
  • Performs data entry activities in a consistently accurate manner and accounts for all fees and fines received by the court.
  • Prioritizes job-related activities to ensure the efficient operation of the court and completion of all assignments in a timely and thorough manner. 
  • Responds quickly and effectively to inappropriate and/or violent behavior when required.
  • Beginning January 1, 2010, each judicial commissioner who is appointed to serve pursuant to this section must complete twelve (12) hours of continuing education each calendar year, ten (10) hours of which must be completed by attendance at conferences or courses sponsored or approved by the Judicial Commissioners Association of Tennessee. The remaining two (2) hours may be completed by attendance at classes sponsored by either the Judicial Commissioners Association of Tennessee or the Tennessee Court Clerks Association, or by local in-service education. At least six (6) hours of the total twelve (12) hours must be taught by a person who is licensed to practice law in this state. Any judicial commissioner who is licensed to practice law in this state is authorized to use continuing legal education credits toward completion of the ten (10) hours, which otherwise must be completed by attendance at conferences or courses sponsored or approved by the Judicial Commissioners Association of Tennessee.
  • All judicial commissioners must complete, as part of the twelve (12) required hours, the following classes:  At least two (2) hours concerning domestic violence or child abuse; At least one (1) hour concerning bail and bonds; and At least one (1) hour concerning ethics. 

Other Duties and Responsibilities
  • Perform various administrative jobs such as creating reports, filing, scanning, correspondence, memorandums, etc., using word processing, spreadsheets, graphs, and PowerPoint presentations.
  • Required to be on-call and standby for some week nights, occasional weekends, and holidays as a Judicial Commissioner, as needed.
  • Conducts research as needed.
  • Maintain a professional and courteous manner in all functions of the job, including contact with the general public and other governmental entities.
  • Works with the auditor.
  • Any other duties as assigned by the Chief Deputy Court Clerk and Court Administrator.
  • Conduct behavior at all times to reflect positively on the customer's perception of the Town.
  • Promote a teamwork environment and assist co-workers when necessary.
  • Help maintain the cleanliness of machines, work areas, and facilities.
  • Provide coverage in the absence of other personnel.
  • Performs customer service functions; assists customers at the window, answers phone, provides information/assistance regarding department services, activities, procedures, fees, or other issues; distributes forms/documentation as needed; responds to routine questions, complaints or requests for service; initiates problem resolution.
  • Collection and entry of payments by phone and in person.
  • Performs various administrative functions.


Minimum Qualifications

  • Must be at least 18 years of age.
  • Must possess a valid Tennessee Driver’s License.
  • Must have a bachelor's degree in criminal justice, pre-law, paralegal studies or related area of legal studies. Minimum of two (2) years working in a law firm or court-related position or any equivalent combination of education, training, and experience which provides the requisite knowledge, skills, and abilities for the position. 
Once Hired : Must complete the required training to earn Judicial Commissioner status within 12 months
