About the Department
Under general direction, assists in planning, organizing, directing, and evaluating the programs of the Equal Opportunity Department, advancing the goals of equal opportunity, diversity, and civil rights on a County-wide basis; and performs related personnel and administrative functions, including the supervision of subordinate professional and clerical staff.
Position Duties
Depending on the area of assignment, positions are assigned any of the following tasks:
- Plans, organizes, directs, and evaluates the activities and staff of the Equal Opportunity Department;
- Analyzes and plans for the effective and efficient utilization of personnel and resources to accomplish equal opportunity goals;
- Develops, administers, and coordinates a comprehensive County-wide equal opportunity program in the areas of County employment, contract compliance, civil rights legislation enforcement, and Disadvantaged Business Enterprise Programs and Diversity initiatives, and Reasonable Accommodation Policy and Procedures to ensure compliance;
- Implements services, studies, and projects in support of equal opportunity for persons with disabilities and assists Human Resources with special recruitment efforts;
- Analyzes County employment practices and identifies problems in recruitment, testing, job structuring, supervisory practices, job qualifications, career development or other elements of the human resources system, and recommends corrective action;
- Determines objectives and strategies to meet program goals and evaluates program effectiveness, implementing modifications as needed;
- Formulates and implements policies, plans, and procedures for carrying out functions of the program;
- Ensures compliance with equal opportunity and civil rights mandates and reporting requirements, and evaluates County-wide policies to ensure compliance with state and federal regulations;
- Directs the development and establishment of services, studies, projects, and special employment programs in support of equal opportunity for women, minorities, or disabled persons;
- Provides prevention and diversity training for County employees, and coordinates training activities with the Employee Development staff, and/or oversees comprehensive ADA and reasonable accommodation training;
- Selects, hires, supervises and evaluates program staff;
- May direct and maintain information/data systems and direct the analysis of statistical data and workforce utilization reports, and prepares reports on program status, progress, and needs in order to evaluate, plan, and implement the program both on a County-wide basis and for individual departments;
- Provides an analysis of new and revised statutes and proposed legislation in the areas of equal opportunity and civil rights issues that includes their effects on County programs and departments;
- Uses research methodologies including review of current literature, selection of decision making models, and selection of alternate solutions, in looking at issues and problems in the areas of equal opportunity and civil rights;
- Manages the County's Disadvantaged Business Enterprise Programs to assure compliance by contractors and consultants;
- Coordinates the activities of equal opportunity personnel within all County agencies and departments;
- Manages the discrimination complaint process;
- Develops, administers, and coordinates the equal opportunity function for the disabled for employees; and ensures public access to County of Santa Clara services, programs and functions;
- Conducts administrative review of Equal Opportunity decisions;
- Assesses employees for reasonable accommodation placement;
- Provides staff support to the County's Council on Equal Employment Opportunity and Advisory Commission for the Disabled, and/or community groups and organizations on employment issues affecting disabled persons;
- Investigates or oversees resolution of discrimination/harassment complaints;
- May be assigned as a Disaster Service Worker, as required;
- Performs other related duties as required.
Minimum Qualifications
Sufficient education, training, and experience which demonstrates possession and direct application of the following knowledge and abilities.
Training and Experience Note: The required knowledge, and abilities required to perform this function are acquired through training and experience equivalent to a Bachelor's degree. Relevant analytical, administrative, lead, supervisory or management experience that includes interpreting rules and regulations, gathering data and formulating recommendations, and report writing can substitute for education on a year-for-year basis;
Four (4) years of experience performing equal opportunity investigations and/or Reasonable Accommodation compliance. Lead or supervisory experience is desirable.
Knowledge of:
- Federal and state legislation, regulations, case law, principles, practices, and procedures pertaining to civil rights, equal opportunity, and ADA/FEHA;
- Principles of supervision, training, and management, including selection, hiring, supervision, evaluation, discipline, training and staff development;
- Human Resources and management staff services functions, including labor relations, classification, recruitment, testing, selection, placement, career development, and human resource planning and training;
- Barriers to employment for women, minorities, and persons with developmental or physical disabilities;
- Statistical methods and communication techniques utilized in the presentation of management information;
- Contract compliance procedures and practices;
- Administration and requirements of Disadvantaged Business Enterprise regulations, practices, and procedures;
- Goals, purposes, functions, services, and activities of County government;
- Discrimination/harassment complaint investigation;
- Statistical analysis techniques;
- Outreach methods to attract a targeted population;
- Employment problems faced by the disabled, women, and minorities;
- Current federal, state, and local programs designed to improve the status of women, minorities, and disabled persons;
- Principles of organization and administrative, fiscal, and program management;
- Principles of learning theory and teaching methods;
- Principles and techniques of organizing and motivating groups;
- Current research, trends, and methods used in solving and preventing problems in the field of equal opportunity and civil rights;
- Dispute resolution techniques.
- Plan, organize, direct, and evaluate activities and staff within the Equal Opportunity Department;
- Conduct detailed analysis of complex problems and identify practical, alternative actions and solutions;
- Take initiative, reason logically, and be creative in developing and introducing new ideas, strategies, services, studies, and projects;
- Devise and direct special employment programs in support of women, minorities, or persons with disabilities;
- Ensure compliance with equal opportunity and civil rights mandates;
- Work with diverse public and private agencies, and community groups;
- Supervise, train, develop and motivate staff;
- Evaluate an equal opportunity program using outcome data to determine the effectiveness of program components and make program modifications as necessary;
- Identify and monitor trends in the fields of equal opportunity and civil rights;
- Conduct needs analyses and surveys;
- Develop and maintain statistics;
- Utilize computers and computer software systems;
- Be sensitive to cultural, ethnic, gender, and socio-economic diversity, including varied educational levels;
- Communicate effectively, both orally and in writing, including effective public speaking;
- Analyze new and revised statutes and proposed legislation to determine effects on County programs and departments, as well as their impact on the community and community groups;
- Advocate effectively by supporting as well as proposing appropriate legislation;
- Establish and maintain effective working relationships in a multi-cultural workforce and community;
- Interpret and effectively apply codes, rules, laws, and regulations;
- Effectively train and motivate individuals and groups.
