Summary: 

The successful candidate is a proven team player and will join a dynamic, professional, and respected Licensing team aspiring to grow the licensing business of the company. Through thought leadership, this role will influence the licensing industry and environment positively and strengthen the Licensing team focusing primarily on delivering patent royalty revenue in the smartphone market. This role is highly collaborative and requires a global mindset and the ability to work across licensing programs and verticals, as well as with various groups supporting the licensing business. The internal collaboration partners include the Legal, Corporate Development, Research and Innovation, Government Affairs, Communications, and Finance departments.  Together, these teams comprise more than 500 members worldwide and include significant experience relating to generating and licensing standard essential patents (“SEPs”) as well as implementation patents.    

This position will report directly to the Vice President, Head of Mobile Licensing, and will also support this leader in their responsibility of commercial coordination across the various InterDigital licensing programs, in particular in the SEP space. In support of this role, the selected individual will be responsible for licensing a broad set of SEPs relating to wireless and video technologies and non-SEPs that cover these technologies, among others.   

The ideal candidate in this role will have demonstrated effectiveness as a negotiator in some cross-border IP licensing deals and providing detailed and supportable valuation analysis of patent licensing and other related transactions.  The candidate will provide direction and guidance across a matrixed team of support functions including but not limited to the following:  infringement analysis; technical due diligence and litigation support.  The individual should have the ability to handle a full negotiation of business terms and support the Legal Team in its drafting of key agreements.  There will be significant growth opportunities for this individual and, as a result, he or she should have the ability to interact with senior level executives both internally and externally.

Responsibilities: 

  • Prepare detailed and comprehensive financial models and presentations.

  • Negotiate with potential licensees.

  • Review, help draft and provide input into agreements reached in the course of such negotiations.

  • Review and ensure compliance with third-party licensing terms and conditions.

  • Participate in the development of strategies, tactics and priorities to protect, assert and enforce intellectual property rights and to develop, maintain and enhance royalty revenues.

  • Participate in the identification of patents to be asserted, potential infringers and appropriate approach and priority of action.

  • Provide feedback and guidance on opportunities to continuously evaluate and improve related business processes and licensing/legal templates.

  • Support the Corporate Development, Finance and/or Legal Team(s) at times on various M&A projects relating to licensing, valuation and best licensing practices. 

Education:

  • J.D. from an accredited law school required.

  • Degree in engineering and either an MBA or strong understanding of finance preferred.

Qualifications: 

  • Demonstrate and leverage prior experience in patent licensing negotiations and knowledge of laws and trends relating to intellectual property.

  • 3-5 years’ experience in the following areas and contexts is strongly preferred:  IP procurement, IP litigation in a law firm, IP consulting, corporate licensing or valuation and general client-facing advice relating to IP-based transactions (e.g., M&A, in-or out-bound licensing).

  • Working knowledge of leading SEP valuation jurisprudence and strategies.

  • Relevant licensing experience, reviewing and negotiating a wide variety of intellectual property transactions, with emphasis in patent license agreements.

  • Strong financial modeling skills in Microsoft Excel is required.  This includes: (a) DCF-based non-litigation IP valuation experience, including presentation/defense of positions taken and final work product to external audiences; (b) calculating economic damages in IP litigation matters, including in high-tech technology areas, such as mobile, IoT, video and semiconductors; and (c) experience in using Monte Carlo simulation techniques to account for uncertainty in financial models.

  • Significant experience in developing and using patent analytics to formulate IP strategies such as: (a) identifying in-bound and outbound licensing opportunities; (b) finding white-space available for patenting,  understanding the patent landscapes in various technology areas; and (c) improving operational excellence within the Licensing Team.

Skills and Additional Qualifications:

  • Excellent presentation and communication skills, both verbal and written (e.g., Microsoft PowerPoint).

  • Excellent interpersonal skills; must work well in fast-paced, highly collaborative, team environment and effectively manage multiple deadlines and deliverables. 

  • Excellent business judgment, ability to think strategically and give practical advice. 

  • Prior experience working in industries related to telecommunications and video codecs is preferred.

Other:

  • Domestic and foreign travel required.

  • United States is preferred location.

A reasonable estimate of the current salary range specific to New York is $210,000 - $260,000 /annually + discretionary incentive bonus, benefits and may include other forms of compensation components such as long-term incentives.  Compensation for the role will depend on a number of factors, including a candidate’s qualifications, skills, competencies and experience and may fall outside of the range shown.
